Subject: Revised Listing of Food and Nutrition Service (FNS) Approved Enriched Macaroni Products with Fortified Protein

This release serves to provide you with advance notice of the US Department of Agriculture's (USDA) new policy and procedures designed to improve the management of the Child and Adult Care Food Program (CACFP). On June 20, 2000, President Clinton signed the Agricultural Risk Protection Act of 2000 (P. L. 106-224). Implementation of the provisions contained in the Act will significantly impact current requirements for contractors participating in the CACFP. The majority of the changes must be implemented by October 1, 2000, or upon receipt of guidance from the USDA.

Proposed regulations containing a small number of provisions are expected in September and will allow an opportunity for comment; however, separate interim regulations are not anticipated to be released until October 20, 2000, with no opportunity for comment before the provisions are implemented.

In order to initiate implementation, USDA has provided Special Nutrition Programs (SNP) with guidance regarding provisions contained in the interim rule. We have attached a chart which outlines the more significant requirements and the impact of each. Unless otherwise noted, the provisions apply to all CACFP contractors administering the program in child care centers, adult day care centers and family day care homes.

SNP will issue policy alerts as soon as possible prior to October 1, 2000, in an effort to allow the maximum time frames for implementation. SNP also plans to do an amendment to the Application/Management Plan and/or Agreement for affected contractors since applications for Program Year 2001 are currently being processed.
