The Texas Department of Agriculture is proposing to adopt the repeal of Texas Administrative Code, Title 4, Part 1, Chapter 26, Subchapter A concerning the Texas Public School Nutrition Policy. The agency determined, due to the release of new strict federal standards for all foods and beverages sold in school, repeal of entire section is more efficient and reasonable than to propose amendments for additional state requirements. Texas Administrative Code regulations would continue restrictions related to deep fat frying.
All Texas public schools participating in the federal child nutrition programs must comply with all federal policies defined by the U.S. Department of Agriculture’s Food and Nutrition Service. As a result of local nutrition and wellness policies, school districts may have stricter nutrition guidelines.
