SB376 -- Universal Breakfast

Overview

Senate Bill 376  (83rd legislature) requires that school district campus or an open-enrollment charter school participating in the national school breakfast program in which 80 percent or more of the students qualify for a free or reduced-price breakfast to offer a free breakfast to each student.  SB 376 text is available at http://www.capitol.state.tx.us/tlodocs/83R/billtext/pdf/SB00376F.pdf#navpanes=0.

Frequently Asked Questions

  1. How will I be notified that I must participate in universal breakfast? Superintendents and Child Nutrition Directors were provided a hardcopy letter with a list of campuses that met the criteria listed in SB 376 in January 2015.
  2. How can I apply for a waiver? Waivers are submitted in TXUNPS. The waiver form is open from March 15 through June 30 each year.
  3. Do I need to apply for a waiver annually? Yes, TDA will determine whether campuses’ meet the 80% free & reduced threshold annually; campuses that meet this criteria must apply for the waiver annually.
  4. When will I receive notice that I have been approved for a waiver? Waivers will be provided as soon as possible. Waivers will be officially approved by the Texas Education Agency; however notification of the waiver approval will come via the Texas Department of Agriculture.
  5. How can I participate in Universal Breakfast? Schools have several options to offer universal breakfast. Please visit our Community Eligibility Provision page for more information.
