Extreme Heat/Air Quality Non-Congregate Waivers Available in Summer 2024

USDA has approved TDA's request to allow SFSP or SSO non-congregate service on days in which a Heat Advisory/Heat Warning is issued by the National Weather Service, or an Air Quality Index "purple" flag or higher is issued. All operators must notify TDA via the Extreme Heat/Air Quality Non-Congregate Waiver Request form (updated version coming soon) and submit the form for each day that non-congregate meals were served. Note that rural SFSP or SSO sites already approved for non-congregate service do not need to submit this form.

While a site does not need approval prior to serving non-congregate meals under these conditions, TDA will verify that there was an officially declared extreme heat or air quality warning for the affected area and notify the sponsor that the non-congregate meals served on the requested day are allowable. Any non-congregate meals served on days when these warnings were not in effect will be disallowed, as will any non-congregate meals served on days for which a request form was not submitted.

Additionally, this waiver does allow for meal service time deviations under the following requirements:

-- Meal times must not be changed within 24 hours in advance of the previously scheduled meal service time.
-- Sponsors/sites must have printed notice or poster at the site indicating the change in meal service times to attendees,
-- Sponsors/sites must alert the community of the changed meal distribution time through appropriate channels (such as school or neighborhood listservs)

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
